Conveyancing

Conveyancing is the transfer of ownership of property from one individual or company to another individual or company usually through a deed of title.

A solicitor’s involvement in conveyancing matters includes: setting the terms of the Contract of Sale of Land; advising clients about these contracts; initiating any searches, enquiries or requisitions relevant to the property in question; checking the title of the property; coordinating the delivery of legal documents and settling, or concluding, the matter.

Enduring guardianship

An enduring guardianship is the choosing, and the formalising of the choice, of an individual to make personal or everyday life decisions on your behalf if and when you are not capable of doing this yourself. The person setting up the enduring guardianship chooses what, and how, decisions or functions are to be carried out. The individual who establishes the enduring guardianship may revoke the guardianship.

Personal injury

Personal injury refers to the area of law that seeks to protect victims who are harmed by the action or inaction of another person or entity.

Power of attorney

A Power of Attorney is a legal document that allows one individual to authorise another individual, or more than one individual, to act as an Attorney on their behalf in all of their financial and property related matters. An individual may want to appoint an Attorney in situations where: they are going overseas or interstate; they are going into hospital; they are physically unable to look after their affairs, or they want a particular matter to be dealt with in some other part of the country.

Probate

Probate is the process that transfers legal title of property from the estate of a person who has died. The process is overseen by an executor if there is a Will or by a court if there is no Will.

Probate involves identifying and taking inventory of the deceased person’s property, accounting and appraising the property, and then paying taxes and creditors with the deceased assets. If there is a Will, the assets are distributed according to the instructions of the Will. If not, then state law determines who gets what and how much.

Enrights Solicitors has extensive history and expertise in obtaining probate, administering the estate and where there is no Will acting on letters of administration of the estate.

Wills

A Will is legally binding document that states how all your property is to be distributed at your death. A Will should be: in writing, signed by your self, and witnessed by two adults who have seen you sign the Will. A Will should be stored safely, in a place known to others.
